剛拿回護(hù)照，三天前面簽通過的L1A。

L1簽證適用于公司內(nèi)部轉(zhuǎn)移，可以有公司集中申請(blanket petition)，基本要求：

1. 過去三年中在公司工作了一年以上；2. 公司在美國有運(yùn)營實(shí)體。具體對公司有一些要求，就不細(xì)說了。具體而言，L1簽證又分L1A和L1B：L1A適用于管理人員，L1B適用于專業(yè)技術(shù)人員。申請時(shí)都要闡明工作職責(zé)和能力對公司而言是不可或缺，不能在美國招聘到替代人員，且工資高于平均水平。L1簽證申請人可以有移民傾向，家屬以L2簽證赴美可以工作。這兩種簽證的區(qū)別主要在于L1A申請綠卡時(shí)通過EB1C流程，不用再經(jīng)勞工部審查就不用受配額限制去等幾年的排期，且簽證最長可以有七年；L1B申請綠卡則要走普通通道，簽證最長可達(dá)五年。根據(jù)自己的經(jīng)驗(yàn)，具體說一下L1A。一般介紹都說L1A適用于“高管”，其實(shí)要求沒那么高。按USCIS說明，L1A適用于Executive or Manager，而一般的問題都在于Manager的定義，畢竟Executive在公司里還是蠻明確的。根據(jù)法案8 CFR 214.2(l)(1)(ii)要求，Manager的職能要求有四點(diǎn)：(1) Manages the organization, or a department, subdivision, function, or component of the organization;(2) Supervises and controls the work of other supervisory, professional, or managerial employees, or manages an essential function within the organization, or a department or subdivision of the organization;(3) Has the authority to hire and fire or recommend those as well as other personnel actions (such as promotion and leave authorization) if another employee or other employees are directly supervised; if no other employee is directly supervised, functions at a senior level within the organizational hierarchy or with respect to the function managed; and(4) Exercises discretion over the day-to-day operations of the activity or function for which the employee has authority. A first-line supervisor is not considered to be acting in a managerial capacity merely by virtue of the supervisor's supervisory duties unless the employees supervised are professional.需要特別說明的是，沒有直接下屬是可能滿足L1A要求的。我在準(zhǔn)備申請材料時(shí)咨詢過一些人，他們都把有下屬(direct report)作為L1A的要件，甚至要求有幾個(gè)以上。我自己查了資料，再與美國專做移民的律所聯(lián)系，并最終和公司處理我的申請的律師確認(rèn)，可以按functional manager申請。不過也需要注意，在公司官方出具的職位描述上需要明確滿足上面的四點(diǎn)要求。
