外國(guó)人在中國(guó)境內(nèi)工作并獲取勞動(dòng)報(bào)酬的，應(yīng)按規(guī)定事先取得工作許可和工作類居留證件（合并稱為“工作簽證”），才可以在中國(guó)合法就業(yè)。持有工作簽證的外國(guó)人，在有效期內(nèi)可以多次往返中國(guó)和境外，不需要另外辦理簽證。外國(guó)人首次辦理工作許可和居留許可一般為12個(gè)月有效，期滿可以申請(qǐng)延期。

Category B (foreign professional talents, control category, professional talents: foreign professional talents who are in urgent need of the development of China's economic and social undertakings and meet the work guidance directory and job demand of foreigners coming to China)

C類（外國(guó)普通人員，限制類，根據(jù)國(guó)家政策規(guī)定，實(shí)行配額管理。）三類，按照外國(guó)人來華工作分類標(biāo)準(zhǔn)實(shí)行分類管理。您必須達(dá)到至少C類，才能申請(qǐng)外國(guó)人來華工作許可（這是在上海合法工作的必要文件）

Category C (foreign ordinary personnel, restricted category, subject to quota administration according to national policies) For the third category, classified management shall be implemented according to the work classification standards for foreigners in China. Category A work permit standards:

B1 - 外國(guó)人有學(xué)士學(xué)位，以及學(xué)士學(xué)位畢業(yè)后2年全職相關(guān)工作經(jīng)驗(yàn)

B2 - 外國(guó)藍(lán)領(lǐng)技術(shù)工人（持有國(guó)際通用職業(yè)技能資格證書的）有2年全職相關(guān)工作經(jīng)驗(yàn)并且平均工資收入不低于本地區(qū)上年度社會(huì)平均工資收入4 倍的外籍人才（以上海為例，月薪大于等于26100元，政府機(jī)關(guān)下一年度會(huì)檢查外國(guó)人個(gè)人所得稅稅單）

B3 - 外國(guó)語(yǔ)言教學(xué)人員。外國(guó)語(yǔ)言教學(xué)人員應(yīng)從事其母語(yǔ)國(guó)語(yǔ)言教學(xué)，并取得大學(xué)學(xué)士及以上學(xué)位且具有2年以上語(yǔ)言教學(xué)工作經(jīng)歷。其中，取得教育類、語(yǔ)言類或師范類學(xué)士及以上學(xué)位的，或取得所在國(guó)教師資格證書或取得符合要求的國(guó)籍語(yǔ)言教學(xué)證書的（如公認(rèn)的TEFL或TESOL證書，則可以免除2年以上語(yǔ)言教學(xué)工作經(jīng)歷的要求）。

B4 - 外國(guó)人綜合評(píng)定超過60分

B3 - foreign language teaching staff. C3、法國(guó)千人實(shí)習(xí)計(jì)劃實(shí)習(xí)生（6個(gè)月短期實(shí)習(xí)）

C1. Foreigners study in Shanghai and obtain a bachelor's degree or higher (within 1 year of graduation from any university in Shanghai). The registered address of the employer is in Shanghai free trade zone or zhangjiang hi-tech park.

具體看辦理哪個(gè)國(guó)家的簽證，大部分情況下外籍人在中國(guó)辦理簽證與中國(guó)人辦理簽證是一樣的，但是要提供外籍人在華長(zhǎng)期居住的證明，如果無法提供準(zhǔn)備則無法申請(qǐng)。一般來講外籍人在國(guó)內(nèi)申請(qǐng)簽證需要交給駐目的國(guó)家的使館，也可以咨詢代辦，但大部分代辦都不受理外籍人士辦理簽證。
